The clients bought their first weeks at Marriott Vacation Club in Marbella in 1999 and again in 2002. In 2004 they bought at Marriott Son Antem. In 2004 again in Marriott Marbella Beach, and in 2005 another week in Marriott Marbella Beach. The total maintenance fees were €17,000 per year. 

These contracts are clearly illegal because they do not guarantee to have the weeks available to the client on the date each year. 

The companies MVCI Holidays and MVCI Management, which are part of Marriott Vacation Club, will have to refund part of the purchase price ($100,184 + €58,960.50) plus double the amount paid during the cooling-off period ($63,250 + €89,625), for a total of $163,434 + €148,585. 

Additionally, they must pay interest from 1999 until now, which amounts to around €80,000.

The clients bought their first weeks at Marriott Vacation Club in Marbella in 2004 and every time they went on holidays, they attended a Sales Presentation and bought another week. The total maintenance fees were €5,000 per year. 

These contracts are clearly illegal because they do not guarantee to have the weeks available to the client on the date each year. 

Marriott Vacation Club will have to refund part of the purchase price (€86,256) plus double the amount paid during the cooling-off period (€119,800), for a total of €206,056. Additionally, they must pay interest from 2004 until now, which amounts to around €70,000.

These Dutch clients wanted to cancel their membership at Marriott Vacation Club in Marbella. They purchased the timeshare in 2003. 

When they tried to book the weeks, Marriott always answer that the gold period is fully booked except say one week in October and a couple of weeks in December.

The clients wanted the cancellation of contracts and to get their money back from Marriott and were represented by us.

The Court ruling was that the contract was declared null and void and Marriott Vacation Club were ordered to repay €76,424.

These clients purchased 2 weeks at the Marriott Vacation Club Marbella Beach resort. 

They promised them that they could sell the weeks when they no longer used the timeshare, but it was not true because there are no buyers for this product.

We have sued MVCI (Marriott Vacation Club International) to cancel the contract and return the money, and this has been the result.

Total recovery: $31,706

£8,208 plus interest €6,578 from 2006

French clients who were invited to a sales presentation by Marriott Vacation Club, bought a week and then every year they had so much trouble booking that they decided it was useless to keep the timeshare.  

They asked Marriott Vacation Club to “resell” the unit but were told that it was not possible.

We have made the claim for the cancellation and the return of the money, and this is the sentence.

These customers are English and bought at Marriott Vacation Club’s Marbella Beach resort. 

After 14 years, they can no longer bear the constant increase in maintenance fees. Even during COVID, they couldn’t use their week but, had to continue paying maintenance bills to MVCI Management SL. 

Now Marriott Vacation Club has to refund the money they paid for the contract because it is null and void.

$41,752 + $61,400 = $103,152 total refund

These customers paid $61,400 for the purchase of several weeks at Marriott Marbella Beach. 

They have had many problems using the weeks because Marriott Vacation Club claimed there was a lack of availability.

For the same reason, the contract is null and void: it is not legal to buy the use of a week annually and then have Marriott tell you that there is no availability. 

Now Marriott has been ordered to refund part of the price they paid ($41,752) plus double the amount ($61,400) because they paid during the cooling-off period. 

In total, Marriott Vacation Club must pay $103,152.

€12,114 refund

The client bought a week in the Silver season, which is cheaper. But the maintenance fees charged by MVCI Management started at €520 and are now €1,125.

Marriott Vacation Club did not inform the customer of the increase in maintenance fees, among many other things, and that’s why the contract is null and void, and Marriott must refund €12,114 (the price minus the time used).

€19.900 refund

These customers are Irish and bought their week at Marriott Marbella Beach in 2010. 

The contract does not specify the termination date. No Marriott contract specifies the day it ends, and for that reason, it is null and void.

A contract must have an end date, and in Spain, the maximum is 50 years.

In this case, Marriott Vacation Club has to refund €19,900 minus the enjoyment time of these 12 years.

In this case, Marriott does not have to pay double because the customer did not pay during the cooling-off period but paid after three months of signing the contract.

€21,840 + €18,814 + €31,200 + €25,425 = €97,279 total refund

Dutch customers purchased a week from Marriott Vacation Club in 2006, paying €31,200, and in 2009, Marriott sold them another week for €25,425. 

The customers have three complaints: Marriott always tells them that there is no availability for the weeks they want to stay, Marriott has increased their maintenance fees from €690 that they started paying to 1,164 per week in 2021, and they have tried to sell the week, but Marriott has informed them that it is almost impossible. 

The option has been to seek our help to sue Marriott Vacation Club for the nullity of the contracts and the refund of the money paid: €21,840 for the 2006 contract and 18,814 for the 2009 contract. 

Additionally, Marriott will have to pay double because they charged during the cooling-off period (€31,200 + 25,425). In total, Marriott will have to pay 97,279.

€12,208 refunded

The English clients were invited to Marbella by Marriott Vacation Club. 

The condition of the invitation was to attend a Presentation Sales, where Marriott used heavy sales techniques, including offering a price for today only. 

Marriott also claimed that at the end of timeshare ownership, the asset would increase in value.

The clients purchased a Silver season week in a 2-bedroom apartment.

Marriott Vacation Club was sued and had to refund part of the money.

£7,445 refunded

The clients had a Silver week purchased in the year 2000 at Marriott Vacation Club Marbella Beach. 

The contract is also null and void, but since they have used the week for more than 20 years, the money that Marriott has to refund is £7,445. 

However, the clients are happy because they no longer have to pay those very high maintenance fees.
